Notice of Intent to Remediate to an
Environmental Standard
Pursuant to the Land Recycling and Environmental Remediation Standards Act, the Act of May 19, 1995, P.L. 4, No. 1995-2 (designated as the Act), notice is hereby given that the Martinsburg Borough will be submitting to the Pennsylvania Department of Environmental Protection (PADEP) a Notice of Intent to Remediate for a property located at 114 W. Penn Street, Borough of Martinsburg, Blair County, Pennsylvania (Site). The Site historically operated as an automobile dealership and an RV dealership. Soil and groundwater contamination are present from a historical gasoline underground storage tank and waste oil storage area. Constituents of concern within the soil at concentrations above the applicable Act 2 U/NR soil to groundwater MSCs consist of benzene, 1,2,4-trimethylbenzene, antimony and lead. Constituents of concern within the groundwater at concentrations above the applicable NR MSCs consist of benzene.
Based on the known impacts to soil and groundwater, the selected Act 2 cleanup standards for this release shall be the site-specific standard (SSS) that will insure that all potential exposure pathways to sensitive receptors are eliminated. As required by Act 68 of 2007, the Uniform Environmental Covenants Act (UECA), the demonstration of attainment of the selected Act 2 non-residential SSS remedial clean-up standard via exposure pathway elimination for this Site will require the use an environmental covenant (EC). Due to the nature and the extent of the contamination, the EC will place activity and use limitations (AULs) utilizing both engineering and institutional controls on the Site property that shall be maintained over time. These AULs will minimize the potential for human exposure to the residual impacts to a level at which the known exposure pathways shall present an acceptable level of risk for all current and future land uses. A Post Remediation Care Plan will be necessary in order to ensure that release conditions continue to meet the selected SSS cleanup standard.
Act 2 provides for a 30-day public comment period for the remediation under the SSS. The 30-day comment period is initiated with the publication of this notice. Until 30 days after this publication date, interested parties may submit a request to the borough be involved in the development of the remediation plans for the Site. Copies of this request and any comments should also be submitted to the PADEP Southcentral Regional Office, 909 Elmerton Avenue, Harrisburg, PA 17110.
